1 definitions

 

 In these conditions the following terms have the following meanings:


"Company" or  ''we'' or ''us''  or ''our''  means        jura management ltd - trading as ''maps-warehouse''
"Customer" means any legal person or corporate body who's order is accepted by us
"Contract" means any contract for the supply of Goods by us to the Customer
"Goods"  means any goods forming the subject of this contract including parts and components of or materials incorporated in them
"Services" means any services
provided.

 

 

  Delivery

 

2.1    UK delivery charges    

 

Delivery charge is a flat    £1.95  on items with RED buy buttons ie    Buy  

 

For all other items the following applies.......

 

Standard charges are based on order value as follows

 

Order Value    

                         £    0.01  - 12.99  =  £ 1.95     

                         £  13.00  - 29.99  =  £ 2.95

                         £  30.00  - up       =  £ 3.95     maximum charge

                         

 

Small and lightweight items will normally be delivered by first class mail. Please note that some larger and heavyweight items will be sent second class or parcels service.

 

2.2   For overseas delivery charges please contact us.

   

2.3 Some products offered for sale may not always be in stock. You will usually be  be notified should an item be out of stock and / or delivery likely to exceed 7 days.

Some mapping is limited in availability and whilst we will endeavour to get it to you as quickly as possible, some delay may be inevitable.....please order as early as possible  (for holiday, trekking, exploration use etc.

 

3  Quotation

 Quotations unless otherwise stated shall be open for acceptance within  30 days of the date of the quotation.

 

 

4  Contract

4.2 These conditions take precedence over any stipulated by the customer.

 

5  Prices

5.1 Prices shown include Vat at the current rate, where applicable.


6  Payment  

6.1  in no circumstances shall the Customer be entitled to make any deduction or withhold payment for any reason.

 

7  Title
7.1  Goods shall remain our property and title shall not pass to the Customer until the amount due under the invoice has been paid in full.

 

8  Risk, Delivery and Performance
8.2 Although we aim to supply all items ordered in one delivery we  may deliver by installments in any sequence.


8.3 Any dates quoted by us for the delivery of the Goods are approximate only and shall not form part of the Contract.


8.4 we shall not be liable for any penalty, loss, injury, damage or expense arising from any delay or failure in delivery or performance from any cause.

 

 

9  Claims Notification

9.1  claims  that any Goods  have been delivered damaged, are not of the correct quality or quantity or do not comply with their description must  be notified  to the us within in 7 days of their delivery.


9.2 the Customer shall if  requested  by us,  return any Goods  and any packing materials  to us for examination.

 

 

10  Scope of Contract

Under no circumstances shall we have any liability of whatever kind for:


10.1 Any defects resulting from wear and tear, accident, neglect, improper use or use by the Customer except in accordance with the instructions.


10.2 Any Goods which have been adjusted, modified or repaired (except by us)

 

 

11  Force Majeure

we shall not be liable for any act or omission arising which shall render performance of the Contract impossible or shall in any way have the effect of frustrating the common cause where such act or omission is beyond the control of either the Company or the Customer or was not reasonably foreseeable by them. Such acts or omissions shall have the effect of automatically terminating the contract.

 

12  Law and Jurisdiction

These Terms and Conditions shall in all respects be construed and interpreted in accordance with the Law of Contract in England and Wales notwithstanding the effect of the law of the European Union. Where the Company and the Customer have contracted to perform in England and Wales or Scotland the competent Court of Jurisdiction shall be the High Court of England and Wales . Where the Customer is resident in the European Union or EFTA, the Company may at its absolute discretion nominate the Court of the Customer's member state to be the Court of competent jurisdiction under the Brussels Convention. Where the Customer is resident elsewhere the Company shall possess the absolute discretion as to the competent court or jurisdiction.
